1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Top Down Design LLC ("Company," "we," "us," or "our"), a Delaware limited liability company located in Orlando, Florida, regarding your use of the Stellara mobile application ("App" or "Stellara").

By downloading, installing, or using Stellara, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use Stellara.

2. Description of Service

Stellara is an AI-powered astrology application that provides personalized horoscopes, birth chart analysis, and compatibility readings. Our services include:

• Daily, weekly, and monthly horoscope readings
• Birth chart calculation and interpretation
• Compatibility and synastry readings
• Push notifications for daily horoscopes
• AI-generated personalized astrological content

3. Entertainment Purposes Disclaimer

STELLARA AND ALL ASTROLOGICAL CONTENT PROVIDED THROUGH THE APP ARE FOR ENTERTAINMENT PURPOSES ONLY. THE HOROSCOPES, READINGS, AND INTERPRETATIONS PROVIDED BY STELLARA SHOULD NOT BE CONSIDERED AS PROFESSIONAL ADVICE, INCLUDING BUT NOT LIMITED TO MEDICAL, LEGAL, FINANCIAL, OR PSYCHOLOGICAL ADVICE.

You acknowledge and agree that:

• Astrological readings are not scientifically proven and should be treated as entertainment.
• You should not make important life decisions based solely on astrological readings.
• For matters requiring professional advice, you should consult qualified professionals.
• The accuracy of readings depends on the accuracy of birth information you provide.

4. AI-Generated Content

Stellara uses artificial intelligence to generate personalized astrological content. You acknowledge that:

• AI-generated content may occasionally contain errors or inaccuracies.
• The quality and relevance of readings depend on the information you provide.
• AI systems may produce different results over time as they are updated and improved.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

5. Account Registration

To use Stellara, you must create an account using Apple Sign-In or Google Sign-In. You agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access to your account.
• Be responsible for all activities that occur under your account.

6. Subscription Terms

Stellara offers both free and premium subscription tiers:

6.1 Free Tier

The free tier provides access to daily horoscopes and basic birth chart information, supported by advertisements.

6.2 Premium Subscriptions

Premium subscriptions ("Stellara Pro") provide access to additional features including weekly and monthly horoscopes, compatibility readings, and an ad-free experience. Subscription options include:

• Monthly: $4.99 per month
• Quarterly: $9.99 per 3 months
• Yearly: $29.99 per year

6.3 Auto-Renewal

SUBSCRIPTIONS AUTOMATICALLY RENEW UNLESS AUTO-RENEW IS TURNED OFF AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT PERIOD. YOUR ACCOUNT WILL BE CHARGED FOR RENEWAL WITHIN 24 HOURS PRIOR TO THE END OF THE CURRENT PERIOD.

6.4 Managing Subscriptions

You can manage or cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for the unused portion of any subscription period.

6.5 Price Changes

We may change subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal.

7. Refund Policy

All purchases are processed by Apple through the App Store. Refund requests must be submitted directly to Apple in accordance with their refund policy. We do not have the ability to process refunds directly.

8. User Responsibilities

By using Stellara, you agree to:

• Use Stellara only for lawful purposes and in accordance with these Terms.
• Not use Stellara in any way that could damage, disable, or impair our services.
• Not attempt to gain unauthorized access to any portion of Stellara or its systems.
• Not use Stellara to transmit any malware, viruses, or harmful code.
• Not use automated systems to access Stellara without permission.
• Not misrepresent your identity or affiliation.

9. Intellectual Property Rights

Stellara and all content, features, and functionality, including but not limited to text, graphics, logos, icons, images, audio, and software, are owned by Top Down Design LLC and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use Stellara for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of Stellara without our written permission.

10. Disclaimer of Warranties

STELLARA IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that Stellara will be uninterrupted, secure, or error-free; that defects will be corrected; or that Stellara is free of viruses or other harmful components.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOP DOWN DESIGN LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF STELLARA.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Top Down Design LLC from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to your violation of these Terms or your use of Stellara.

13. Termination

We may terminate or suspend your access to Stellara immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use Stellara will immediately cease.

You may delete your account at any time through the app settings. Account deletion will result in the permanent removal of your personal data, subject to our data retention requirements.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the federal or state courts located in Delaware.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiations. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue legal remedies.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the app or by other means. Your continued use of Stellara after such changes constitutes your acceptance of the revised Terms.

19. Acknowledgment

BY USING STELLARA, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE STELLARA.
